Guided by the above-mentioned vision and values, these Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at https://mousamdey.com/ (together or individually “Service”) operated by Margspectrum Holdings.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound of them.

If you do not agree with (or cannot comply with) Agreements, then you may not use our Products, Platform and Services, but please let us know by emailing at support@margspectrum.com so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.

3. Communications

By using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at support@margspectrum.com

4. Purchases

If you wish to purchase any product or service made available through Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including but not limited to, your credit or debit card number, the expiration date of your card, your billing address, and your shipping information.

You represent and warrant that:

(i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that

(ii) the information you supply to us is true, correct and complete.

We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

5. Contests, Sweepstakes and Promotions

Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through Service may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.

6. Cancellation and Refunds

6.1 General Refund Policy

  • All refund requests must be submitted in writing via email to our official support team at support@margspectrum.com.
  • Refund requests must be submitted from your registered email account. Provided all required documentation is complete, refunds will be processed.
  • Refund eligibility is based on the type of program or service purchased and the time of the cancellation request.
  • Refunds, if applicable, will be processed using the original payment method within 25-30 business days after approval.

6.2 Refund Policy for Paid Programs

  • If you cancel within 24 hours of enrollment, you will be eligible for a 90% refund, provided you have not accessed any program content.
  • After 24 hours but before 30 days, a 80% refund will be granted, provided you have not accessed any program content.
  • After 30 days of enrollment, no refund will be issued under any circumstances.
  • If a discount was applied to your Program fees, you’ll receive the refund of the discounted amount following on the above policies. Discounts are only valid when officially announced by us.
  • Refunds are not available for Program registrations made with gift coupons.

6.4 Refund Policy for Subscription-Based Services

  • Subscriptions are non-refundable once the service period has commenced.
  • You may cancel your subscription at any time, but the cancellation will be effective at the end of the current billing cycle.

6.5 Refund Policy for Live or Scheduled Programs

  • Refunds will only be considered if the cancellation is requested at least 15 days prior to the program start date. A processing fee of 10% will be deducted.
  • No refunds will be provided for cancellations made within 7 days of the program start date or after the program has commenced.
  • In the event of program cancellation by Margspectrum, a full refund or alternative rescheduling will be provided.

7. Reschedule Policy

  • If you are unable to attend a program for which you have registered, you may request a reschedule to a later date or batch, subject to availability.
  • Reschedule requests must be submitted at least 7 days before the program registration date.
  • In that case, a rescheduling fee of 15% of the program fee will apply.
  • Each participant is allowed a one time rescheduling per enrollment without any rescheduling fee. Any further requests will require rescheduling fee as per the previous policy.

8. Re-Registration Policy

  • If you have previously enrolled in a program and wish to re-register after withdrawal or cancellation, you may do so based on availability.
  • A re-registration fee of 50% of the program fee will be charged without any discount.
  • If you were provided a partial refund upon cancellation, the re-registration fee will be calculated on the remaining balance.
  • Re-registration for the same course or program is permitted for a period of 6 months following the original program’s commencement. Please note that if the program’s cost has risen, you’ll be required to cover the price difference, along with a re-registration fee.

9. Transfer Policy

  • Participant Transfer: Participant transfer is not allowed for any programs. 
  • Program Transfer: You may request to transfer your enrollment to another program, provided you have not accessed any program content for which you have registered.
  • Only one time program transfer is allowed.
  • Transfers are subject to approval and availability.
  • For the approved transfer, a transfer fee of 25% of the program fee (25% of the program you are transferring to) will apply. Please note that you’ll be required to cover the price difference, along with the transfer fee.
  • All the approved transferred programs must need to complete within a time period of 6 months following the original program’s registration.
  • Program transfer is not available for Program registrations made with gift coupons.

10. Language Upgrade Policy (For Multilingual Programs)

  • Language upgrade is only applicable if you request within 24 hours of registration, provided you have not accessed any program content.
  • If you wish to switch to another language version of a program, a language upgrade fee of 20% of the program fee (20% of the program you are upgrading to) will apply.
  • Language upgrades are subject to availability and may not be applicable to all programs.
  • Language upgrades are not available for the bulk registrations and bundled purchases.

11. Exceptions to Refunds and Cancellations

  • Refunds will not be granted for technical issues caused by the participant’s device, internet connectivity, or system compatibility.
  • Refunds or transfers will not be provided for failure to attend a session or complete a course.
  • Refunds or cancellations will not be applicable for registrations made with gift coupons, bulk registrations and bundled purchases.

12.Policy Amendments

Margspectrum reserves the right to modify this refund and cancellation policy at any time without prior notice. Participants are advised to review the terms before enrollment.

13. Ownership & Intellectual Property Rights

13.1 Proprietary Rights

  • All content provided by Margspectrum, including but not limited to text, images, videos, audio, designs, graphics, logos, articles, blog posts, whitepapers, training materials, program materials, tools, applications, databases, and software, is the exclusive property of Margspectrum and/or its licensors.
  • Such content is protected under international copyright laws, trademark laws, trade secret laws, and other applicable intellectual property laws.

13.2 Trademarks & Branding

  • All the properties of the brands of Margspectrum Holdings, such as name, logo, slogans, product names, and branding elements are trademarks of Margspectrum. Unauthorized use, imitation, or reproduction is strictly prohibited.
  • Users may not use the trademarks of Margspectrum Holdings for commercial, promotional, or misleading purposes without explicit written permission.

13.3 Copyright Protection

  • All course and program materials, e-books, training sessions, articles, research papers, and other proprietary documents are copyrighted and may not be copied, republished, or distributed without express permission.
  • Unauthorized reproduction, modification, or sale of our content may result in legal action, financial penalties, and account suspension.

14. User-Generated Content & Submission Policy

14.1 User Contributions

    Margspectrum Holdings allows users to contribute content in various forms, such as:

    • Comments, testimonials, reviews, blogs, forums, discussions, social media posts, images, videos, and other submissions.
    • By submitting User Content, you grant Margspectrum a perpetual, non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and modify such content for promotional, educational, and commercial purposes.

    14.2 Content Moderation & Removal

    Margspectrum reserves the right to:

    • Review, monitor, edit, or remove user-generated content at its sole discretion.
    • Ban or suspend accounts that repeatedly violate content guidelines.

    14.3 Prohibited Content

    Users may not submit content that:

    • Infringes copyrights, trademarks, patents, or intellectual property rights.
    • Contains hate speech, violence, discrimination, defamatory statements, or threats.
    • Violates privacy rights or shares personal, sensitive, or confidential information without consent.
    • Promotes illegal activities, scams, fraudulent claims, or misleading information.
    • Disrupts, hacks, or manipulates our platforms or servers.

    Any violation of these rules may result in content removal, account suspension, legal action, and potential civil liability.

    16. DMCA & Copyright Protection Policy

    16.1 Digital Millennium Copyright Act (DMCA) Compliance

    Margspectrum adheres to DMCA regulations and promptly responds to copyright infringement claims. If you believe your copyrighted material has been used unlawfully, submit a DMCA Takedown Request with:

    1. Detailed description of the copyrighted work.
    2. Proof of ownership or registration of the work.
    3. URL/location of the infringing material.
    4. Your contact details (name, email, phone number).
    5. A sworn statement affirming the complaint’s legitimacy.
